DON’T SILENCE DEMOCRACY FOR DEVELOPERS’ PAYDAY

OPPOSE HB2191 (Yes in God’s Back Yard)

 

NEIGHBORHOODS NOT INVESTOR-HOODS ! 

HB2191 would bypass zoning to allow development of dense housing on property owned by religious institutions.

HB 2191 is anti-democratic because it:

• Bulldozes cities’ and towns’ General Plans that are approved by citizen vote every 10 years as required by law.

• Prevents the public from being informed of and involved in consideration of radical zoning changes that impact where they live.

• Denies citizens their rights under Article 2, Section 4 of the Arizona Constitution.

• Removes the zoning process requirement for properties owned by religious institutions.

• Imposes a one-size-fits-all development that would greatly impact neighborhoods with multiple churches and low-density infrastructure.

• Unfairly taxes citizens to support development they had no say in approving.

• Generates loopholes so affordable housing might not even be built.

We don’t need the state to mandate rubber-stamp approvals that bypass zoning. By removing zoning, HB2191 would eliminate neighbors and the city from the decision-making process, leaving developers in charge and neighborhoods in peril.

People who live near churches are clearly stakeholders in this issue and yet they weren’t included in the drafting of the bill or the amendments.

All of us need to work together to create intelligent housing solutions.  Neighbors are NOT opposed to “affordable housing” and we care about people who have difficulty affording a place to live.  

There are solutions to providing less expensive housing that do not eliminate zoning or create conflicts between houses of worship and their neighbors.  

Legalizing inclusionary zoning would go a long way towards creating affordable housing while keeping zoning intact. Inclusionary zoning could be used to require all apartment buildings to offer some units at affordable prices. Arizona is one of only seven states in the US that prohibit inclusionary zoning.

We need thoughtful legislation, not good intentioned bills like this one whose impacts have not been carefully considered.
